Cancellation & Refund Policy

At Sailing Charters Malta, we will do our utmost to ensure that you receive the best possible sailing yacht charter experience aboard one of our yachts.

Unfortunately, there are times where circumstances are completely out of our control and rarely oblige us to cancel some of the day trips or week charters that have previously been booked. We list them below.

1. Adverse Weather Conditions

Adverse weather conditions are conditions, which either prevent the boat from leaving its home base Marina or which prevent the boat trip from taking place whilst ensuring the safety and comfort of our customers.

Examples of adverse weather conditions

  • Strong wind forecast with speeds exceeding Force 5 on the Beaufort scale.
  • Forecast of strong waves , with a wave height of more than 1.5 meters
  • Prediction of intense rain or possibility of squalls

It must be noted that meteorology and the prediction of the weather is not always 100% accurate especially during the shoulder months (I.e spring or the end of summer). In the case of uncertain situation, we will always take the prudent approach and will be able to take a final decision 24 hours before the start of the charter. In the case where a charter has to be cancelled due to bad weather conditions, the CHARTERER may choose to cancel or reschedule the booking. In the case of a cancellation, any charter deposits and payments paid in advance shall be returned by the OWNER in full to the CHARTERER without further liability to the OWNER. In the case whereby a Multi-Day charter would have already been initiated but the Captain decides to cancel a remaining part of the charter due to expected and previously unforeseen bad weather conditions, a Pro Rata Refund will be provided for the remaining unconsumed period.  

2. Mechanical or Boat Failure

Should it be impossible for the OWNER to make delivery due to unforeseen circumstances, the OWNER shall do his utmost to provide an alternate yacht with similar specifications to the yacht booked. Should it be impossible to provide an alternate solution, the CHARTERER may cancel or reschedule the booking. In the case of cancellation any charter deposits and payments paid in advance shall be returned by the OWNER in full to the CHARTERER without further liability to the OWNER.

3. Force Majeure

This relates to any cause attributed to acts of GOD such as accidents, natural disaster, weather or other occurrences beyond the reasonable control of the OWNER, and not caused by the OWNERS negligence.

Refunds

Refunds will be processed within 48 hours, by bank transfer, to the account indicated by the customer.

Cancellations by Client

In the event that the client, due to any circumstances, including unexpected and uncontrollable situations, could not carry on with the booked day charter or multi-day yacht charter, the client would lose any deposit paid. The reason arises from the fact that once we confirm your booking, we would block that yacht or boat for that particular booking and that particular date and thus we would start refusing other requests for that same date hence this would ultimately risk having the booked yacht not operating on that particular date.
